These Terms and Conditions ("Terms") govern your access to and use of the Rollout platform, operated by Rollout Pty Ltd ABN [insert ABN] ("Rollout", "we", "us", or "our").
The Rollout platform (accessible at rollout.net.au) is an online marketplace that connects owners of civil construction equipment ("Owners") with businesses and individuals seeking to hire that equipment ("Hirers").
By registering an account or using the Rollout platform, you agree to be bound by these Terms. If you do not agree, you must not use our platform. Please read these Terms carefully before proceeding.
These Terms should be read together with our Privacy Policy, which governs how we handle your personal information.

Where you are registering on behalf of a business or company, you represent and warrant that you have authority to bind that entity to these Terms, and references to "you" include that entity.
We reserve the right to verify eligibility at any time and to refuse or revoke access where eligibility requirements are not met.
You must create an account to use most features of the platform. When registering, you agree to provide accurate, current, and complete information, and to keep that information up to date.
You are responsible for maintaining the confidentiality of your account credentials. You must not share your login details with any other person. You are responsible for all activity that occurs under your account. If you become aware of any unauthorised use of your account, notify us immediately at support@rollout.net.au.
Owners who wish to list equipment on the platform are required to complete identity verification. This involves providing a government-issued photo ID and may include a liveness check. Rollout reserves the right to refuse or revoke listing access where verification fails or cannot be completed.
You may not create more than one account per person or entity. Duplicate accounts may be merged or removed.
Rollout is a marketplace platform, not a party to hire agreements. The hire contract for any machine is between the Owner and the Hirer directly. Rollout facilitates the connection and payment between those parties but does not own, operate, inspect, or warrant any machine listed on the platform.

A booking request is made when a Hirer submits a request for a specific machine and date range. A booking request is not a confirmed booking until the Owner accepts it and payment is successfully processed.
A booking is confirmed when the Owner accepts the request and the Hirer's payment method is successfully charged. Both parties will receive a booking confirmation email. At this point a binding hire agreement exists between the Owner and the Hirer.
The hire agreement between Owner and Hirer is formed on the terms set out in these Terms and Conditions, the listing description, and any additional terms agreed between the parties in writing via the platform messaging system. In the event of any conflict, these Terms prevail.
You must not arrange or attempt to arrange hire of a machine outside the Rollout platform where you first became aware of that machine through Rollout. Circumventing the platform to avoid platform fees is a material breach of these Terms and may result in immediate account termination.
Rollout charges fees for facilitating bookings. Our current fee structure is:

Rollout reserves the right to amend its fee structure at any time. Changes will be communicated with at least 14 days' notice to existing users and will apply to bookings made after the effective date of the change.
All payments are processed securely through Stripe. By providing payment details, you authorise Rollout to charge the applicable fees in connection with your bookings. Rollout does not store your full card details.
Owners receive payouts via Stripe Connect to their nominated bank account. Payouts are made after the hire period is complete, subject to any dispute resolution periods. Rollout's commission is deducted automatically before payout.
All fees displayed on the platform are inclusive of GST where applicable. Rollout will provide appropriate tax documentation upon request.
If you believe you have been incorrectly charged, contact us at support@rollout.net.au within 14 days of the charge. We will investigate and respond within 5 business days.

If an Owner cancels a confirmed booking:
If the machine is unavailable, unfit, or materially different from the listing at the time the hire is due to commence, the Hirer may cancel and receive a full refund. The Hirer must notify Rollout within 24 hours of the scheduled hire start.
Refunds are processed to the original payment method and typically appear within 5–10 business days depending on your bank or card provider.
Rollout offers an optional float (transport) service that allows Hirers to arrange delivery and pickup of hired machines through approved Transport Partners.
Float quotes are calculated automatically using distance, machine weight class, and state-based rate cards. Quotes for machines over 30 tonnes are provided manually. All quotes are estimates — final pricing may vary in circumstances such as site access issues, permit requirements, or significant route changes.
Float services are performed by independent Transport Partners approved by Rollout. Transport Partners are not employees or agents of Rollout. Rollout coordinates the arrangement but is not the transport carrier.
Some machine weights and transport routes require transport permits under applicable state laws. Where a permit is required, Rollout will notify the Hirer. Permit costs, where applicable, are additional to the quoted float price. The Transport Partner is responsible for obtaining required permits.
Transport Partners are required to hold Goods in Transit insurance. Any damage that occurs during transport should be reported to Rollout immediately. Claims against transport damage are handled through the Transport Partner's insurance, with Rollout acting as a coordinator.
Rollout does not provide insurance cover for machines, operators, or third parties. Users are responsible for obtaining appropriate insurance before listing or hiring any machine.
Owners are strongly recommended to hold:
Some standard plant insurance policies exclude cover while a machine is on hire. Owners must check with their insurer.
Hirers are responsible for:
Rollout holds no position as insurer in any hire transaction and accepts no liability for loss, damage, or injury arising from the hire, operation, or transport of any machine. This is addressed further in Section 17.
If a machine is returned damaged (beyond fair wear and tear), the Owner must:
The Hirer is liable for the reasonable cost of repairing damage to the machine that occurs during the hire period and is attributable to the Hirer's use, negligence, or breach of these Terms. Fair wear and tear is excluded.
Where a dispute arises between an Owner and a Hirer regarding damage, condition, or other hire matters, Rollout will:
Rollout's determination is a recommendation only. Rollout is not a tribunal and its determination does not affect the parties' rights to pursue a matter through appropriate legal channels, including NCAT (NSW), VCAT (VIC), or other relevant state tribunals.
Users found to have made false or exaggerated damage claims will have their accounts terminated and may be referred to relevant authorities.
Rollout operates a two-way review system for completed bookings. Reviews are subject to the following rules:
Rollout reserves the right to remove reviews that violate these Terms. If you believe a review about you is false or defamatory, contact us at support@rollout.net.au.
The following conduct is strictly prohibited on the Rollout platform:
Rollout reserves the right to investigate suspected violations and to suspend or terminate accounts where prohibited conduct is found to have occurred. We may also report conduct to relevant law enforcement authorities.
All intellectual property in the Rollout platform — including the website, software, design, trademarks, and content created by Rollout — is owned by Rollout Pty Ltd or its licensors. You may not copy, reproduce, distribute, or create derivative works from any of this content without our prior written consent.
When you submit content to the platform — including listing descriptions, photos, messages, and reviews — you grant Rollout a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute that content for the purposes of operating and promoting the platform. You retain ownership of your content.
By submitting content, you represent and warrant that you own it or have the right to grant this licence, and that it does not infringe the intellectual property rights of any third party.
To the maximum extent permitted by applicable Australian law, Rollout's liability to you for any loss or damage arising from your use of the platform is limited as set out below.
Rollout is not liable for:
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), including any applicable consumer guarantees. Where Rollout's services are supplied as a service to consumers, our liability for a failure to comply with a guarantee is limited to the resupply of those services or payment of the cost of having them resupplied, at our election.
To the fullest extent permitted by law, Rollout's total aggregate liability to you in connection with any claim arising from these Terms or your use of the platform shall not exceed the total Platform Fees paid by you to Rollout in the 12-month period preceding the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless Rollout Pty Ltd, its directors, officers, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:
You may close your account at any time by contacting us at support@rollout.net.au. Closing your account does not affect any obligations arising from bookings that are in progress or completed prior to closure.
We may suspend or terminate your account, with or without notice, if:
Where we suspend or terminate your account for cause, we are not obliged to provide a refund of any fees paid, except as required by Australian Consumer Law.
On termination, your right to access the platform ceases. Provisions of these Terms that by their nature survive termination (including liability, indemnity, and intellectual property clauses) continue to apply.
These Terms are governed by and construed in accordance with the laws of Australia. You submit to the non-exclusive jurisdiction of the courts of Australia in respect of any dispute arising out of or in connection with these Terms or the platform.
Nothing in this clause limits your rights as a consumer under Australian Consumer Law.
We may update these Terms from time to time. When we make material changes, we will notify you by email and display a notice on the platform. The updated Terms will take effect 14 days after the notice is given.
Your continued use of the platform after that date constitutes acceptance of the revised Terms. If you do not accept the revised Terms, you must close your account before the effective date.
